Civil Process
The Utah County Sheriff’s Office provides service for all types of civil process. We do not provide forms or templates for civil process or legal advice. The Utah State online court assistance program gives detailed information that answers frequently asked questions and also has outlines, links and forms to assist with obtaining the civil process to be served (including evictions). Fees:
Utah State Statute allows for the Sheriff’s Office to receive fees for process services. The amounts are governed by code. 17-22-2.5, UCA. The amount charged is determined by the type of process plus mileage. http://le.utah.gov/UtahCode/getCodeSection?code=17-22-2.5
Cases involving persons booked into the County Jail on Civil Bench Warrants require special fees to be paid to house the prisoner in addition to the process and mileage fees, (17-22-10, UCA). The housing fees are calculated on the current cost to house a prisoner for three days. Contact the Judicial Division (801-851-4035) to calculate fees.
Effective July 1, 2009, the Utah County Sheriff’s Office will be requiring the service fee and three mileage attempt fees at the time we receive civil process for service. We will refund service fees if the paper is not served and/or any of the three paid mileage fees which are not used during the service.
