Approval by legislative body; USC - 57-8-35 Description of Perimeter of project; USC - 57-8-13(1.a) Location & dimensions of units; USC - 57-8-13(1.b,c), 57-8-10(2.a.ii) Elevations; USC - 57-8-13(1.c) Units must each have a distinguishing number or symbol; USC - 57-8-13(1.e), 10-8-3(27) Easements (if feasible). USC - 57-8-13(1.f) 3. Declaration must contain: Description of the perimeter of project; USC - 57-8-10(2.a.i) Undivided interest each unit has in the common area; USC 57-8-7, 57-8-10(2.d.i) Executed & acknowledged by all record owners. USC - 57-8-10(8.a) F.Y.I. 1. A condominium may have language in the declaration that will allow it to be: Expandable, this is very common; USC - 57-8-3(14), 57-8-10(4), 57-8-13(2), 57-8-13.6. This requires survey map and amended declaration - to show new percent interests in the common area and the description of remaining expandable lands. Contractible; USC - 57-8-3(9), 57-8-13(s), 57-8-10(5) Convertible. USC - 57-8-3(10,11), 57-8-10(3), 57-8-13(2) 2. Removal of property from statutory provision (Filing of an affidavit of withdrawal). requires consent of all unit owners. USC - 57-8-7(2), 57-8-22(1) Requires that holders of liens affecting any of the units, consent or agree by instrument duly recorded that their liens be transferred to the percent interest of the unit owner in the property. USC - 57-8-22(1) After removed from statutory provision the property will be owned in common by the unit owners. USC 57-8-22(2) 3. Code specifies plat size to be 21"x31" - smaller than D size. USC - 57-8-13(1) 4. Actual location of the constructed building to take precedence over the mapped location. USC - 57-8-13(4) 5. Declaration may be amended. USC - 57-8-10(2.d.iv)
